Jurisdiction and Powers of the Magistrate court is stipulated in section 23(1) of the Magistrates Court Ordinance Cap 52. The division operation is managed and controlled by the Chief Magistrate. A total number of Magistrates’ Courts in Kiribati is 24. The Magistrate division is comprised of the Administration Unit, Single Magistrate Unit, the Outer Island Magistrate Unit and the Clerkship Magistrate unit. The Administration Unit oversee and leads full operation of the Magistracy division throughout Kiribati.
The team consists of the Chief Magistrate, the Principal Magistrate and Senior Magistrate.
The Single Magistrate Unit is under the supervision of the Principal Magistrate. The unit consists of Magistrates who adjudicates and preside over land, civil and criminal matters on South Tarawa and Kiritimati only. The composition of the Magistrates’ Court and appointments of the Magistrates is stipulated under section 7(1) of the Magistrate Court Ordinance cap 52. The current number of Single Magistrates adjudicating on South Tarawa and Kiritimati totals to 11 but are assisted by the Chief Magistrate and Principal Magistrate hearing cases filed at Betio, Bairiki and Bikenibeu courts.
